1. Acceptance of Terms

By accessing or using the WowCommerce AI platform, website, or services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

WowCommerce AI provides an autonomous e-commerce growth platform that uses artificial intelligence to manage and optimize e-commerce operations, marketing, and customer interactions across multiple channels (e.g., Shopify, WooCommerce, Meta, Google Ads, WhatsApp).

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account.

4. Subscriptions and AI Credits

Certain features of the Service require a paid subscription. Subscriptions are billed on a recurring basis as specified at the time of purchase. Some features may also require "AI Credits," which are consumed based on usage. Credits may be included with your subscription or purchased separately. Unused credits may expire according to the terms of your specific plan.

5. Third-Party Integrations

The Service integrates with various third-party platforms. Your use of these integrations is subject to the terms and conditions of those third-party providers. You are responsible for maintaining the necessary accounts and permissions with these providers. We are not responsible for the availability or performance of third-party services.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third-party intellectual property right.
  • Interfere with security-related features of the Service.
  • Attempt to access or search the Service or download content from the Service through the use of any engine, software, tool, agent, device, or mechanism (including spiders, robots, crawlers, data mining tools, or the like) other than the software and/or search agents provided by us.
  • Use the Service to send unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, or other forms of solicitation.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of WowCommerce AI and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9. Limitation of Liability

In no event shall WowCommerce AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page.
